Service Agreement & Refund Policy

1. Scope of Engagement
Each consulting engagement with John Wiencek Consulting LLC ("the Firm") is governed by a written Statement of Work ("SOW") executed by both parties. The SOW defines the scope, deliverables, timeline, fees, and acceptance criteria for the engagement.
2. Professional Fees
Consulting fees are for professional time and deliverables. Fees become due upon execution of the SOW and are invoiced according to the payment schedule specified therein. All fees are quoted in United States Dollars and are exclusive of applicable taxes.
3. Refund Eligibility
Clients may request a refund of the engagement deposit if the initial audit deliverable defined in the SOW has not been provided within fourteen (14) calendar days of the agreed engagement start date, provided the Client has supplied all reasonably requested information and access required for the Firm to perform its obligations.
- Refund requests must be submitted in writing to contact@johnwiencek.com within seven (7) calendar days following the 14-day delivery window.
- Approved refunds are processed to the original payment method within ten (10) business days.
- Engagements that have progressed beyond the initial audit phase, or where deliverables have been formally accepted, are non-refundable.
4. Cancellation
Either party may terminate an active engagement with seven (7) days' written notice. Upon termination, the Client is responsible for fees pro-rated to the work performed and any non-cancellable third-party costs incurred on the Client's behalf.
5. Confidentiality
All engagements are governed by a mutual non-disclosure agreement. The Firm will not disclose Client information to third parties without express written consent, except as required by law.
6. Limitation of Liability
The Firm's total aggregate liability arising from any engagement shall not exceed the total fees paid by the Client for that specific engagement. The Firm provides recommendations and deliverables; the Client is responsible for business decisions and implementation outcomes.
7. Governing Law
This agreement is governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
